Welcome to GoBotad. These Terms and Conditions govern your use of our website, mobile application, and the food delivery services we provide. By accessing or using the GoBotad platform, you agree to be bound by these terms. If you disagree with any part of the terms, then you may not access the service.
1. Use of Services
GoBotad operates as a technology platform connecting users with independent restaurant partners and delivery riders. We do not prepare or cook the food ourselves; rather, we facilitate the ordering and delivery process. You agree to use the platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of GoBotad.
2. User Accounts and Responsibility
- Account Creation: You must create an account to place orders. You agree to provide accurate, current, and complete information during the registration process.
- Account Security: You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
- Prohibited Conduct: You agree not to use the platform for any fraudulent activity, to post offensive or inappropriate content in reviews, or to abuse the promotional codes and referral systems.
3. Ordering and Payments
All prices listed on the platform are determined by the respective restaurant partners and are subject to change without notice. When you place an order, you agree to pay all charges incurred, including the food price, taxes, delivery fees, and platform fees. All payments are processed securely via third-party gateways (e.g., Razorpay). We reserve the right to cancel any order if we suspect fraudulent activity.
4. Order Acceptance and Fulfillment
An order placed on GoBotad is an offer to purchase. The contract is formed only when the restaurant partner accepts the order. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in the description or price, or service unavailability in your area.
5. Delivery Logistics
Delivery times displayed on the platform are estimates and may vary based on traffic, weather, and restaurant preparation times. While we strive for timely deliveries, GoBotad is not liable for delays outside of our control. Users must ensure that someone is available at the delivery address to receive the order.
6. Intellectual Property
The GoBotad platform and its original content (excluding content provided by users and restaurants), features, and functionality are and will remain the exclusive property of GoBotad and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Limitation of Liability
In no event shall GoBotad, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
8. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
